General Terms and Conditions

Article 1 - Definitions

In these terms, the following definitions apply:

1. Supplementary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract.
2. Cooling-off period: the period during which the consumer can exercise the right of withdrawal.
3. Consumer: a natural person not acting for purposes related to their trade, business or profession.
4. Day: calendar day.
5. Digital content: data produced and delivered in digital form.
6. Continuous performance contract: a contract for regular delivery over a period of time.
7. Durable medium: any tool enabling storage of information for future reference.
8. Right of withdrawal: the possibility for the consumer to withdraw from the agreement within the cooling-off period.
9. Entrepreneur: Telecomprofs B.V.
10. Distance contract: an agreement concluded via remote communication.
11. Model withdrawal form: the European standard withdrawal form.
12. Means of distance communication: tools such as internet or telephone.

Article 3 - Applicability

1. These terms apply to every offer and distance contract.
2. They are provided before concluding the agreement.
3. In electronic agreements, they are provided digitally.
4. In case of conflict, the most favorable provision for the consumer applies.

Article 4 - The Offer

1. Limitations or conditions are clearly stated.
2. The offer includes a complete and accurate description.
3. Rights and obligations are clearly stated.

Article 5 - The Agreement

1. The agreement is concluded upon acceptance.
2. Electronic acceptance is confirmed promptly.
3. Appropriate security measures are taken.
4. The entrepreneur may refuse an order if justified.
5. Relevant information is provided upon delivery.

Article 6 - Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days without giving any reason.

Article 7 - Obligations of the Consumer

1. The consumer must handle the product with care.
2. Liability only applies in case of improper use.

Article 8 - Exercising the Right of Withdrawal

1. Withdrawal must be communicated clearly.
2. Return within 14 days.
3. Return product in original condition.

Article 9 - Obligations of the Entrepreneur

1. Confirm withdrawal.
2. Refund within 14 days.

Article 10 - Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for custom-made products, hygiene products, and digital content.

Article 11 - Pricing

1. Prices are not increased during validity unless due to VAT changes.
2. All prices include VAT.

Article 12 - Performance and Warranty

The entrepreneur guarantees compliance with legal requirements and product quality.

Article 13 - Delivery

1. Delivery is carried out with due care within a maximum of 30 days.
2. Risk transfers upon delivery.

Article 14 - Duration Transactions

Termination is possible with a maximum notice period of one month.

Article 15 - Payment

1. Payment within 14 days.
2. Maximum 50% prepayment.

Article 16 - Complaints Procedure

1. Complaints are handled within 14 days.
2. Complaints must be clearly described.

Article 17 - Disputes

Dutch law applies to these agreements.

Article 18 - Industry Guarantee

If applicable via industry association.

Article 19 - Additional Provisions

These must not be to the detriment of the consumer.

Article 20 - Amendments

Changes take effect after publication.
